Collection and Use of Personal Information

Nulogy collects and uses information about identifiable individuals (“personal information”) primarily on behalf of and in the course of providing services to our clients. In certain limited contexts, we may collect personal information on our own behalf, such as in connection with visits to our websites, job applications, events and surveys. 

Information we process on behalf of our customers: 

Provision of Services: Nulogy provides a software platform that allows consumer goods companies to manage their external supply chain and that allows contract packagers and contract manufacturers to manage their operations. In the course of providing these services, we may obtain information about our customers’ clients, employees or other authorized users such as business contact information, including first and last name, company name, phone number and email address, as well as any personal information that may be provided on the platform. We require our customers to ensure that they have obtained all the necessary authority to provide personal information to us in accordance with applicable privacy laws. We do not collect or use our customers’ clients personal information for any purpose other than to provide services on behalf of our customers. 

Support Services: We may collect certain information (such as name, email address, phone number and query) when we provide customer support services by phone, email or within the software platform.

Use of the Services: We may monitor use of the services by our customers’ clients or other authorized users in order to detect, investigate or prevent any actual or potential violation of our terms and conditions. We may also generate aggregated, non-identifiable data and use such information to monitor the performance, use and stability of the services and to improve the services.

Visit our Website: When you open the Website, our servers automatically record information that your browser sends. This data may include information such as your device’s IP address, browser type, and version, operating system type and version, language preferences or the webpage you were visiting before you came to the Website and Services, pages of the Website and Services that you visit, the time spent on those pages, information you search for on the Website, access times and dates, and other statistics. We use this information to gain statistical information on website usage and traffic and to identify potential abuse cases, see the “Information about our website” for more details.

Create an Account: If you are a customer, you will be provided with a user account in order to access and use the services. We will collect your name, business contact information (such as company name, address and email address) in order to create and administer your user account, and you will be issued with a username and password login credentials. You must keep your username and password secure and not share it with anyone else either within or outside your organization. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages).

Request a Demo: When you request a demo, we may ask for your name, company name, phone number, and work email address. We use this information to contact you and otherwise facilitate your demo or provide you with a quote.

Marketing Communications: If you choose to sign-up for our marketing communications, we will collect certain information such as your name, company name, phone number and work email address. If you no longer wish to receive these communications, you may unsubscribe at any time by clicking the “unsubscribe” link at the bottom of the email or by contacting us at the contact information under “Contact Us” below. Please note that you may continue to receive certain transactional or account-related communications from us.

Careers: If you apply for a job with Nulogy, you may provide us with certain personal information about yourself, such as information contained in a resume, cover letter, or similar employment-related materials. We use this information for the purpose of processing and responding to your application for current and future career opportunities.

Whitepapers & Gated Content: We may collect your first and last name, company name, work email, and ask you to indicate whether your company provides co-pack services in order to facilitate the download of the whitepaper or gain access to other types of Gated Content, such as Webinars. 

Events: If you attend one of our talks or visit our booth at an event, we may collect business contact information such as your first and last name, company name, work email address and phone number. We collect this information so that we can contact you about future events, promotions, offers and upgrades to our services.

Contests and Promotions: When you enter a contest or participate in a promotion, we may collect your name, address, email address, phone number, and any additional information or content required for the contest or promotion, including to deliver a prize to you, or that you otherwise provide, including your social media handle, profile picture and public posts or comments you make about our contest on social media networks. We use this information to administer your participation in the contest or promotion. As part of a contest or promotion, we may obtain your consent to share or otherwise publish the content you submit.

Contact Us: When you contact us with a comment, question or complaint through email, telephone, or live chat on our Website, you may be asked for information that identifies you, such as your name, company name, work email address and a phone number, along with additional information we need to help us promptly answer your question or respond to your comment. We may retain this information to assist you in the future and to improve our customer service and service offerings.

Call Recording: We may monitor and record our telephone conversations with you for training and quality assurance purposes. You will be provided with a notice at the beginning of any call that is being recorded. If you do not wish to have your call recorded, please let us know.

Sharing of Personal Information

We use service providers to provide services such as hosting the Website, processing payments, providing advertising and marketing services. Our service providers are only provided with the information they need to perform their designated functions and are not authorized to use or disclose personal information for their own marketing or other purposes. Our service providers may be located in the U.S., Canada or other foreign jurisdictions.

Legal and Compliance: We and our Canadian, U.S. and other foreign service providers may disclose your personal information in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.

Sale of Business: We may transfer any information we have about you as an asset in connection with a proposed or completed merger, acquisition or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of Nulogy or as part of a corporate reorganization or other change in corporate control.


Information About Our Website

Visiting our Website:  In general, you can visit our Website without telling us who you are or submitting any personal information. However, we collect the IP (Internet protocol) addresses of all visitors to our Website and other related information such as page requests, browser type, operating system and average time spent on our Website. We use this information to help us understand our Website activity and to monitor and improve our Website.

Cookies: Our Website uses a technology called “cookies”. A cookie is a tiny element of data that our Website sends to a user’s browser, which may then be stored on the user’s hard drive so that we can recognize the user’s computer or device when they return. You may set your browser to notify you when you receive a cookie or to not accept certain cookies. However, if you decide not to accept cookies from our Website, you may not be able to take advantage of all of the Website features.

Analytics: Our Website and Services may use third-party analytics tools that use cookies, web beacons, or other similar information-gathering technologies to collect standard internet activity and usage information. The information gathered is used to compile statistical reports on User activity such as how often Users visit our Website and Services, what pages they visit and for how long, etc. We use the information obtained from these analytics tools to monitor the performance and improve our Website and Services. We do not use third-party analytics tools to track or to collect any personally identifiable information of our Users and we will not associate any information gathered from the statistical reports with any individual User.

Third Party Links:  Our Website may contain links to other websites that Nulogy does not own or operate such as social media websites. We provide links to third party websites as a convenience to the user. These links are not intended as an endorsement of or referral to the linked websites. The linked websites have separate and independent privacy policies, notices and terms of use. We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or disclose, secure and otherwise treat personal information. Interest-based Advertising

We work with third-parties such as ad networks and other advertising companies that use their own tracking technologies (including cookies and pixel tags) on our Website in order to provide you with tailored advertisements across the Internet. These companies may collect information about your activity on our Website and third-party websites (such as web pages you visit and your interaction with our advertising and other communications) and use this information to make predictions about your preferences, develop personalized content and deliver ads that are more relevant to you on third party websites. This information may also be used to evaluate the effectiveness of our online advertising campaigns.

Your opt-out only applies to the web browser you use so you must opt-out of each web browser on each computer or device you use. Safeguards, Retention, Data Breach

We have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfill their job requirements.

We have record retention processes designed to retain personal information for no longer than necessary for the purposes set out herein or as otherwise required to meet legal or business requirements.

In the event we become aware of a disclosure of Users’ Personal Information as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify individuals affected by the breach or if notice is otherwise required by law. When we do, we will send you an email.

Disclosures for residents of the EU/EEA and the UK

If you are a resident of the European Union (“EU”), the European Economic Area (“EEA”), or the United Kingdom (“UK”), you have certain rights in relation to your Personal Information based on the the GDPR and the UK DPA that we comply with as part of our commitment to your privacy. 

Right to withdraw consent: You have the right to withdraw consent where you have previously given your consent to the processing of your Personal Information. 

Right to access: You have the right to obtain a copy of your Personal Information undergoing processing in a structured, commonly used, and machine-readable format.

Right to update: You have the right to request for your information to be updated or corrected. 

Right to object: You have the right to object to the processing of your information if the processing is carried out on a legal basis other than consent.

Right to restrict processing: You have the right, under certain circumstances, to restrict the processing of your Personal Information if our processing is deemed inappropriate.

Right to delete: You have the right, under certain circumstances, to obtain the erasure of your Personal Information from us. 

Right to complaint: You have the right to complain to a data protection authority about our collection and use of your Personal Information.

This section, together with other relevant sections of the Policy, provides information about the rights of data subjects under the California Consumer Privacy Act and the California Privacy Rights Act (collectively, “CCPA”), the Virginia Consumer Data Protection Act (“VCDPA”), and and all regulations arising therefrom.

Right to correct: You have the right to request that we correct your inaccurate Personal Information.

Right to opt-out of the sale and sharing: You have the right to opt-out of the sale of your Personal Information.

Right to restrict the use of your sensitive information: You have the right to restrict the use and disclosure of your sensitive information. 

Right to non-discrimination: You have the right to not be discriminated against in the Services or quality of Services you receive from us for exercising your rights. 

Shine the Light: California residents that have an established business relationship with us have the right to know how their personal information is disclosed to third parties for their direct marketing purposes under California’s “Shine the Light” law, or the right to opt out of such practices.
